1. ACTIVITY
VTC Marseille Van provides its clients, individuals or professionals, with a passenger transport service by reservation using a transport vehicle with a driver.
- The term "client" refers to any legal entity or individual who enters into a transport contract with Vtc Marseille Van.
- A passenger or traveler is defined as any person physically accessing the services of Vtc Marseille Van.
- The term "driver" refers to any person authorized by the company Vtc Marseille Van to perform the transport service.
2. OPENING HOURS
Vtc Marseille Van provides its transport service 24/7 only by reservation, subject to driver and vehicle availability.
3. RESERVATION
Customers wishing to use the services of Vtc Marseille Van are required to make a prior reservation, preferably on the website www.vtcmarseillevan.fr or by email to europeentransfer@gmail.com. They can also call, text, or WhatsApp at +33 (0) 6 27 45 88 54
Reservations are required to access our vehicles. Any quote accepted by the customer will serve as a reservation confirmation.
Access to our services implies full and unreserved acceptance of our general terms and conditions of sale.
If, due to force majeure (strikes, demonstrations, natural disasters, technical problems, weather conditions, accidents causing exceptional traffic), or for any other safety reasons, a transfer must be cancelled or delayed by Vtc Marseille Van, an alternative will be offered. If the client refuses our alternative offer, they will not be entitled to any form of compensation.
4. PRICES
Prices are provided when the quote is drawn up.
Transfers are charged per kilometer. Vehicle availability is charged per hour.
The route and schedule will be determined based on the traffic conditions forecast for the day of service (traffic, roadworks, road closures, weather conditions, etc.). The proposed route will always be the best compromise for both clients and drivers.
Additional costs incurred during transport, tunnels and parking are included.
Additional stops will of course be granted subject to certain conditions: safety, health emergency, driver's available time, etc.
The fares include tolls, overtime due to traffic jams, accidents, weather conditions, fuel, passenger insurance, and the driver's salary. They do not include waiting time exceeding 15 minutes, motorway tunnel fees, or additional stops.
In some cases, the approach distance may be charged.
The prices shown on our website are expressed in euros inclusive of VAT, applying an applicable VAT rate of 10% for transfers and 20% for all other services.
Our prices may be subject to a surcharge:
- Nighttime, 7:00 PM – 8:00 AM
- Sundays and public holidays 00:00 – 00:00
- in the event of exceptional weather conditions making traffic conditions really difficult, particularly in the event of heavy snow and ice.
- during peak hours, on days of high traffic (cross-border traffic, etc.)
Note that any kilometer started is due during a transfer, and any hour started is due during availability.
Final prices are only provided on quotes and confirmed on invoices.
Vtc Marseille Van reserves the right to modify its rates without prior notice in order to adapt to market realities.
5. PAYMENT TERMS
Payment is made in cash or by credit card to the driver. Payment at the time of booking is possible upon request; all payments can be made via PayPal, bank transfer, or credit card through an online payment link.
We do not accept checks.
Companies can benefit from special payment terms. A weekly invoice will be issued, detailing all services performed during that period. Payment is due upon receipt of the invoice and may not, under any circumstances, be made more than 30 days from the date of issue. Any invoice not paid upon receipt will be subject to a penalty equal to ten times the legal interest rate.
6. DRIVER WAITING CONDITIONS
It is the client's responsibility to allow sufficient time for their travel, to account for any unforeseen circumstances, and to strictly adhere to the appointment schedule.
We can give advice on the geographical areas we know, however our advice does not in any way engage the responsibility of the company Vtc Marseille Van.
Any waiting time exceeding one hour: After this period, and without notification from the client, the driver is released from their obligation to provide transportation and considers the reservation cancelled. The service ordered will then be billed in full.
In the event of a customer calling to announce a delay and the ride being maintained, the waiting hour charge will be added to the transport price subject to the availability of the new desired time slot.
7. CANCELLATIONS
You can cancel your booking up to 48 working hours* before the pick-up date and receive a full refund (within 30 days of receiving your cancellation request, minus a €20 VAT-inclusive administration fee).
No refunds will be given outside of these conditions.
8. SUBCONTRACTING
Vtc Marseille Van reserves the right to subcontract bookings to other licensed transport companies in order to carry out a trip booked by the customer.
When you travel with one of Vtc Marseille Van's partner companies, you should be aware that there may be some differences in their way of operating as well as in their General Terms and Conditions of Sale.
9. RESPONSIBILITY
Any claim is only admissible if it is made to Vtc Marseille Van within eight working days after the date of service.
We are committed to doing everything possible to ensure the transport of our passengers under the best conditions of time and safety.
Vtc Marseille Van cannot be held responsible for delays due to force majeure related to traffic disruptions, road closures, traffic jams, demonstrations… (non-exhaustive list) or missed appointments due to incomplete or unspecified address, nor will any compensation be due.
It is the client's responsibility to allow sufficient time for their journey and to plan accordingly, taking into account any unforeseen transportation issues (e.g., airport check-in closing time).
Vtc Marseille Van is guaranteed by a notable insurance company which covers the risks related to its activity, the transport of passengers for hire.
Passengers, third parties in relation to the driver, are covered for bodily injury, property damage and intangible damage they may suffer during a traffic accident, from boarding the vehicle (the entire body being inside the vehicle) until they disembark (the entire body being outside the vehicle), except for damage caused by the driver's fault.
In the event of damage to the equipment or vehicle caused by the passenger, any repair or replacement of equipment, regardless of the cause, will be charged to the customer.
10. LUGGAGE AND ANIMALS
Luggage and its contents are not the responsibility of Vtc Marseille Van, particularly for valuables or fragile items, neither during loading nor during transport.
We accept no responsibility whatsoever for the transport in luggage by our customers of any goods requiring special permits or simply prohibited by the laws of the countries they travel through. It is the passengers' responsibility to inquire about these laws.
Vtc Marseille Van declines all responsibility for personal belongings left in the cars.
It is the client's responsibility to indicate at the time of booking if they are traveling with oversized luggage or animals. Transporting large items of luggage, special equipment, or other items may incur an additional charge. Similarly, transporting animals is subject to a charge of €15 (including VAT) per animal, which covers one space per animal in the vehicle. Any omission by the client at the time of booking may result in an additional charge or even cancellation of the service without compensation, and the full fare will be charged.
As animal transport is regulated, it is the client's responsibility to inquire about the legal requirements related to the category of animal being transported. All animals, regardless of size, must travel in a carrier or bag. If this condition is not met, Vtc Marseille Van will be obliged to refuse the ride. The client will be liable for the cost of the ride and will not be entitled to any compensation.
11. TRANSPORT SECURITY
Since drivers are responsible during the service period, they are instructed to respect and enforce road regulations and applicable laws.
It is mandatory to use equipment appropriate for the age of the children included in the booking. Therefore, parents must specify the number and ages of the children when making the reservation so that Vtc Marseille Van can provide the necessary equipment (car seat, booster seat, etc.).
Under no circumstances may the client demand that the driver exceed the permitted speed limit or commit traffic violations.
Similarly, drivers are prohibited from lending their support to any undertaking or action contrary to morality or good morals.
The customer agrees to behave appropriately, refrain from smoking, and abstain from consuming narcotics or alcoholic beverages inside the vehicle. It is also forbidden to transport flammable, toxic, explosive, corrosive, or any other prohibited substances.
Wearing a seatbelt in both the front and rear seats is mandatory. Failure to comply with this rule releases Vtc Marseille Van from all liability in the event of an accident.
Vtc Marseille Van reserves the right to cease providing service or refuse access to the vehicle to any person exhibiting aggressive, disrespectful, vulgar, or insulting behavior towards customers, passersby, other road users, or the driver. Such cessation or refusal of service will result in full billing and will not entitle the customer to any compensation.
Any damage caused to the vehicle and its equipment will be the responsibility of the customer.
